1. Acceptance of Terms
By accessing and using EUAIActReady ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these Terms of Service, please do not use the Service.
2. Description of Service
EUAIActReady provides an online platform for EU AI Act compliance assessment, risk classification, and compliance documentation. The Service includes:
- AI system risk assessment and classification tools
- Compliance checklists and actionable recommendations
- Document templates for EU AI Act compliance documentation
- Compliance dashboard and progress tracking (Pro and Consultant tiers)
- Team collaboration and client management features (Pro and Consultant tiers)
3. User Accounts
3.1 Account Creation
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in conduct that we deem inappropriate or harmful to the Service or other users.
4. Subscription Plans and Payment
4.1 Subscription Tiers
The Service offers multiple subscription tiers. Current pricing is displayed on our pricing page and may be updated from time to time:
- Free: Access to basic risk classification at no cost, with limited saved assessments
- Pro: Monthly or annual subscription with full compliance features including Annex IV documentation, FRIA reports, standards readiness dashboard, checklist tracking, and team collaboration for up to 5 members
- Consultant: Monthly or annual subscription with white-label branding, client portal, unlimited team members, vendor assessment tools, and API access

4.2 Payment Processing
Payments are processed through Stripe, a PCI DSS Level 1 certified payment processor. We do not store your credit card information. By providing payment information to Stripe, you authorize us to charge the applicable fees to your payment method.
4.3 Refunds
Monthly subscriptions: You may cancel at any time; access continues until the end of the current billing period. No partial refunds for unused time. Annual subscriptions: May be eligible for a pro-rated refund within 14 days of purchase, at our discretion. Contact [email protected] for refund requests.
4.4 Subscription Renewal and Cancellation
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period.
4.5 Price Changes
We may change subscription prices with at least 30 days' prior notice. Price changes apply to the next billing cycle after the notice period. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

5. Usage Limits and Fair Use
Each subscription tier includes specific usage limits for saved assessments, team members, and features. Current limits are displayed on the pricing page. We reserve the right to enforce these limits and may suspend service for accounts that significantly exceed fair use guidelines.
6. Intellectual Property Rights
6.1 Our Content
All content provided through the Service, including assessment methodologies, templates, risk classification algorithms, standards mapping data, and user interface design, is owned by EUAIActReady or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent. For clarity: (a) the platform's assessment logic, scoring algorithms, and pre-built templates remain our intellectual property; (b) any data, text, or information you enter into the Service remains yours; (c) generated documents (PDF reports, DOCX exports, FRIA reports) contain a mix of your data and our templates — you own the output but may not extract or redistribute the underlying template structure separately.
6.2 Your Content
You retain all rights to the data and information you input into the Service. By using the Service, you grant us a limited, non-exclusive license to use this data solely for providing and improving the Service. We will not share your data with third parties except as described in our Privacy Policy.
6.3 Generated Documents
Documents generated through the Service (PDF reports, templates, checklists) are provided for your use in compliance efforts. You own the output generated from your data. You are solely responsible for reviewing, customizing, and validating all generated documents for your specific use case and legal requirements.
7. Disclaimers and Limitations
7.1 Not Legal Advice
IMPORTANT: EUAIActReady is a software tool that provides general guidance for EU AI Act compliance assessment. THE SERVICE DOES NOT PROVIDE LEGAL ADVICE AND IS NOT A SUBSTITUTE FOR PROFESSIONAL LEGAL COUNSEL. Risk classifications, compliance recommendations, and generated documents are for informational purposes only. You should always consult with qualified legal professionals for specific compliance requirements, legal interpretation, and formal regulatory submissions.
7.2 No Guarantee of Compliance
While we strive for accuracy in our risk classification algorithms and compliance guidance, we do not guarantee that use of the Service will result in full compliance with the EU AI Act or any other regulation. The EU AI Act is subject to evolving interpretations by regulatory authorities, and our assessments reflect our understanding at the time of use. Compliance assessment and implementation remain your sole responsibility.
7.3 Service Availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice for material changes.
7.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EUAIACTREADY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, REGULATORY FINES, PENALTIES, OR ENFORCEMENT ACTIONS ARISING FROM RELIANCE ON ASSESSMENTS, REPORTS, OR INFORMATION PROVIDED THROUGH THE SERVICE.
7.5 Accuracy Disclaimer
Information provided by the Service, including risk levels, applicable articles, and compliance recommendations, is generated algorithmically based on your inputs. We make reasonable efforts to keep our methodology current, but we do not warrant that all information is complete, accurate, or up-to-date at all times. Regulatory interpretations may change.
8. Data Protection and Privacy
Your use of the Service is governed by our Privacy Policy and Data Processing Addendum (DPA). We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws. Our DPA, available at /legal/dpa, forms part of these Terms.
9. Prohibited Activities
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service, its systems, or other users' accounts
- Interfere with or disrupt the Service, servers, or connected networks
- Use automated means (bots, scrapers, crawlers) to access the Service without prior written permission
- Resell, sublicense, or redistribute the Service or its content without authorization
- Remove or modify any proprietary notices, labels, or watermarks
10. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the modified terms. If you do not agree, you may cancel your account before the changes take effect.
11. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Germany and the applicable law of the European Union, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Leipzig, Germany.
12. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
13. Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or third-party service outages.
14. Dispute Resolution
In the event of a dispute, the parties shall first attempt to resolve it through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Leipzig, Germany. For consumers within the EU, this does not affect your right to bring proceedings in the courts of your country of residence.

16. Entire Agreement
These Terms of Service, together with our Privacy Policy and Data Processing Addendum, constitute the entire agreement between you and EUAIActReady regarding the use of the Service and supersede all prior agreements and understandings.
